Peter Murphy

Peter is a member of Sacker & Partners dedicated Dispute Resolution Unit.  He has substantial experience of High Court proceedings as well as complaints before the Pensions Ombudsman.  Peter has developed particular expertise in the areas of professional negligence and members' disputes. He is a strong advocate of mediation and alternative dispute resolution.

Recent significant advice

• Acting for the independent trustee in the case of Drake Insurance plc v. MacDonald (2005), which involved the rectification of an incorrect amendment deed regarding early retirement pensions.
• Defending a pensions administrator in High Court proceedings for a claim totalling in excess of £1 million. The claim was a complex one seeking compensation for almost 200 overpayments that had been made over a 10 year period.
• Acting for an employer claiming damages against the Scheme’s administrators and solicitors for failing to implement benefit changes as instructed.
• Representing a trustee in court proceedings brought by a member seeking damages for an incorrect quote provided at the time the member ceased employment.
• Advising trustees and employers in relation to the anti-avoidance provisions of the Pensions Act 2004.
• Acting for trustees in numerous complaints before the Pensions Ombudsman covering a variety of issues from ill-health applications to mistaken overpayment of pensions and failing to properly inform members.
