Michaela Berry comments on LGPS same-sex civil partnership survivor benefits in Pensions Expert
Partner, Michaela Berry, comments on the proposed new rules for the Local Government Pensions Scheme (LGPS) relating to survivor benefits, that will see survivors of same-sex civil partnerships and same-sex marriage receive the same benefits as those currently provided to widows.
It is expected however that the government will rely on the judgment of the ECJ in the case of Barber, to avoid equalising benefits for men and women in service before 1990, since “the costs and implications to do that for all female members with widowers would be much bigger.”
