Sackers comments on Pimlico Plumbers auto-enrolment Supreme court ruling
James Bingham, associate director, comments on the Supreme Court decision upholding the employment status of a plumber as a ‘worker’ rather than a contractor.
The ruling means that as well as the entitlement to statutory benefits such as holiday pay, as a worker, Mr Smith is eligible to be automatically enrolled into the company pension scheme of Pimlico Plumbers.
Discussing the potential impact of the judgment, which it is believed could affect up to 360,000 ‘workers’ in the gig economy, Bingham urges caution, not just in the drafting of contracts, but also to those calling for the Government to further define ‘self-employment’.
