Emma Martin comments on the guidance/advice boundary

Senior counsel Emma Martin is quoted as part of an article in Professional Pensions on the blurred boundary between advice and guidance. The article reports on the current state of play of an FCA/HM Treasury review and looks at views from around the industry. Emma notes that trustees have a duty to look after the interests of members as a whole, not each individual member. She warns: “Trustees have no statutory duty to provide advice to a member. Trustees who cross the advice/guidance boundary may be on the hook for any financial losses suffered by the member.”
